Records, reports and the regulator's view: how CEMS compliance is actually verified

Enforcing the Clean Air Regulations 2014 — Part 5 of 5. A practical series for regulators and compliance staff, drawn from the DOE CEMS Guidelines (Version 8, 2025), which we helped develop.

This series has worked through what the law requires of a CEMS: what “compliant” means under Reg 17(3) (Part 1), how a valid average is built (Part 2), the notification clocks when something goes wrong (Part 3), and the offences and penalties behind it all (Part 4). This final part answers the question underneath the whole series: how does DOE actually see and verify any of it? The answer comes in three layers — a continuous live link, periodic reports, and a multi-year record.

DOE sees your stack in near real time

A CEMS in Malaysia isn’t a private logger you consult when asked. Under the Guidelines (§6.2.6), your system transmits to the DOE System for CEMS — a platform that holds each premises’ CEMS information and its compliance status based on the actual CEMS readings. It is accessible to the CEMS consultant, the CEMS tester, the plant operator and DOE officers, who can view the transmitted data directly.

Two consequences follow that operators sometimes miss. First, the system alerts — it flags excess emissions and prompts operators to carry out scheduled quality-assurance activities; ignoring those notifications is its own failure of diligence. Second, a transmission gap is itself reportable: if your CEMS data fails to reach the DOE server, you must notify DOE. The regulator’s window is meant to stay open, and a dark feed is treated as a problem, not a pause.

The reports you file

The live feed is the continuous layer. On top of it sits a set of periodic reports, each with its own owner and deadline:

  • Quality-assurance test reports. The Functional Test, QAL2-CVT and AST reports are prepared by your independent CEMS tester and submitted to DOE through the DOE System for CEMS, no later than two calendar months after the audit (Guidelines §6.2.1; formats in Appendices 1 and 2).
  • The yearly CEMS evaluation report. The plant operator must submit the results of the CEMS evaluation within three months after the end of each calendar year, as required under Regulation 17 of CAR 2014 (§6.2.2; format in Appendix 3).
  • Monthly data analysis. Routine monthly CEMS data analysis (Appendix 5) is part of keeping your own house in order — and the raw material a yearly evaluation is built from.
  • Event reports. Excess emissions, CEMS failures and shutdowns are reported on Appendix 4 against the 24-hour and one-hour clocks covered in Part 3.

The record you keep

Beneath the live link and the reports is the archive — and this is where many facilities are quietly exposed. The Guidelines (§6.1.1) require the plant operator to maintain a record of:

Keep it all for at least 3 yearsSoftcopy or hardcopy, retained as required under CAR 2014 (Reg 17(5)) and produced to DOE for inspection on request — including the DAHS data display.

The retention rule is the one to underline: all of it, softcopy or hardcopy, for at least three years, available to DOE on request (§6.1.3). An inspection isn’t only about today’s reading — it’s about whether you can reconstruct the last three years on demand.

Why this is the real enforcement mechanism

Put the three layers together and you can see how enforcement actually works. The live feed means DOE can see an excursion close to when it happens — often before you’ve filed anything. The reports make your quality-assurance discipline and annual performance auditable. The three-year record means a question raised today can be tested against years of history. This is the through-line back to Part 4: the same trail that proves good-faith compliance is the evidence in any enforcement action — and with the data link always on, there’s little daylight between what your stack does and what the regulator can see.

For compliance staff, that reframes the job. It isn’t producing a number on a screen; it’s maintaining an unbroken, inspection-ready trail — live, reported and archived — that stands up whenever someone looks.

The takeaway — and the end of the series

Compliance under the Clean Air Regulations isn’t proven in a single moment; it’s demonstrated continuously and on the record. Keep the feed live and report any gap, file the periodic reports on time, and keep three years of everything where you can produce it. Do that and an inspection is a formality rather than a scramble.
